This Proposition is on the November 4, 2008 General Election Ballot
in the State of California located here:

Marijuana Legalization. Individual Rights. Constitutional Amendment.
Summary Date: 04/08/08
Circulation Deadline: 09/05/08
Signatures Required: 694,354

Proponent: Christopher Springer

Amends constitution to legalize marijuana and hemp within California and to provide for broad individual constitutional rights, including rights to food, shelter, medical care, and to be free from “unreasonable” taxation. Allows marijuana to be sold in any store that sells alcohol. Establishes local boards with expansive powers, including powers to regulate and tax marijuana. Requires marijuana tax revenues support specified programs. Exempts marijuana sales profits from income tax. Forbids most testing for marijuana used outside the workplace. Prohibits most marijuana, alcohol, and tobacco advertisements. Immunizes marijuana growers and sellers from liability. Summary of estimate by Legislative ****yst and Director of Finance of fiscal impact on state and local government: Potential savings of up to several tens of millions of dollars annually to state and local governments, which would no longer incur the costs of incarcerating and supervising certain marijuana offenders.

Potential costs of up to the tens of millions of dollars to state and local governments to fund the one-time start-up costs of the local boards. A potentially significant increase in state and local spending on substance abuse treatment services that could possibly be partially or fully offset by revenues from this measure. Potential increased revenues in the tens of millions to low hundreds of millions of dollars annually from marijuana stamps and licenses to support specified programs and the local boards. Unknown but potentially significant increase in state and local revenues from collection of sales and use taxes on the sale of Marijuana. Unknown but potentially significant decrease in state and local revenues from taxes on tobacco and alcohol due to a prohibition of advertising for these goods that would likely result in a decline in sales. if marijuana becomes legal and sold at liquor stores then those damn store owners are gonna over price just like they do on everything else. fcuking cranberry juice is like 8 fcuking bucks!
not to mention the fact that tons of people are going to lose they're "jobs" which in turn will force them to get "real" jobs. God forbid... Then if they get legal jobs they wont be able to stay on welfare.

thats my opinion too, im all for decriminalization, but legalization is a slippery slope.

My arguement every time is that I have been able to buy an 8th for between 50-60 bux for bomb for at least the last 10 years. Now gas keeps going up, cigarettes go up, liquor goes up, everything goes up.... except weed. And the only time the price goes above 60 an 8th is when you go to a ripoff dispensary thats buying from a local grower anyways. All legalization will do is create government control that doesn't exist now. Taxes, inflation, quality control, all enter into the equation when the government gets involved. Lowered penaties for people i can get behind, but full blown legalization is kinda scary.

agreed. i would never buy from a dispensary, it's equivalent to buying from a liquor store(hypothetically speaking). dont care what kinda hybrid chron they have, thats just silly!
can you imagine what doors this would open in the mainstream world if this ish was legal? we would have Chritsian Dior and Prada selling 8th's for $200 just cus the damn thing came in a fancy lil' bag!

see thats decriminalization...

decriminalization lifts the stigma that law enforcement has, basicly telling them not to waste their time on minor problems related to marijuana. Legalization becomes regulation, rather than just having a liberal attitude toward it.

as long as they let you grow your own it would be great, but if they treat it ike tabacoo where it is illega to grow your own than it would be LAME!!!.
then again it is mostly illega to grow your own so not much woud change.. but yea my doctors note only protects me in cali it would be nic eto be be to not be paranoid about smoking weed in NYC or miami at the WMC so I say legalize. I have paud close to 1000$ in fine over weed in my life.. and if I could go out and purchace a pack of joints for the same price as a pack of cigs. I would be happy. you guys are trippin´not t o mention it would pave the way to lgalizing ganja world wide... something that our friends in asai or dubai may appreciate. also if weed/ganja is illegal than they shud make cigs and booze illegal too otherwise its just another stupid law to help kepp sheeple in control and in line.

What are the chances of California decriminalizing marijuana vs. legalizing it with the current economic state?

I think legalization has a much higher chance of passing than decriminalizing it. Also, if you can get good prices on pot now how would it be any different once its legal? Even if the government tries to control it, they can't. It's a plant that can be easily grown

If you buy from a dispensary you should be concerned about this. (see below) Some guy in Moro Bay was charged with distribution of 100 kilos after the supreme court ruled that Federal Law trumps California law in these cases. It only takes one case for a precedent to be set making it very possible for them to bust a whole slew of other dispensaries for the same thing. When they do you know they will take all of the records from that dispensary and I for one have no desire to have my name on that list.

Regardless of federal vs. state its really lame to have your state tell you everything's cool only to serve you up for 85 years in the clink because they can't sort out s**t with the Fed. true that ^ one of my best friends practically owns a dispensary doesn't mean i'm gonna go in there and put myself on the books.

what happens when you go to court and the judge realizes your script is bs? if you're going to have it for headaches (for instance) first go to a regular doctor and get a prescription for vicodins. then go to another doctor and tell him you don't want to take vikes anymore and want pot instead. that will hold up a lot better in court than some person who has no history of problems all of a sudden creates some kind of "condition" for the sole purpose of getting 'legal' pot

I have something to say from teh federal overriding state thing....... Thats only if u push outside the boundaries of the ordinance ur supposed to be following does us become a federal case. I've yet to see in the law where it permits dispensing the medicine, i've always understood it as: You can have it but only in ur private residence under the allotted amount, you can grow it, but away from public eye in ur own private residence and again according to what county, only under the allotted amount..... I've had my card for the last 4years now and everytime i go to court im within my ordinance that i am permitted an all charges are dropped or if its a CHP they sometimes respect my california department of health and safety ID card after verifying my doctor is legit..... The other cool thing i might add, these last 3 years i've been on probation for sellin herb, but still have had my card respected by the courts and probation even though at first they tried to deny me but i found another case where it was respected an the person was in the same situation as me, got on calender, presented with case law and got the OK to stay medical, while on probation...... I support 215 an 420 but the people getting mad about not being honored because they thought they loop-holed the system..... I think Eddy Lepp's case is probably the only one i've been impressed with that has one, none the less they still destroyed the garden.

an if any of you medical heads need assistance after you get ur cards my store is HYDROPONICS4LESS.COM with locations in both Temecula, and Upland for all you're growing equipment needs.

buddy of mine with a prescription had to spend like 3 months in jail for having the allowed amount. reason - he didn't have it on him. so yea if you do get one make sure you have it on you whenever you're carrying

I was not aware that dispensaries kept records. Whenever I would go in I would flash my card to a security guard, they looked at it and then let me in. They didnt write anything down. My doctor has a record that he gave me that note. But the patient doctor rights prevent them from giving over those records. So what are you scared of "the goverment finding out you smoked weed and putting you away for years and years and throwing away the key". Give me a freaking break. Even the president of the U.S.A. did drugs.

dont f**king worry about over priced at a liquor store, cuz u will grow it. (yes i know chances are if they legalize it, you'll need a license to grow and it'll be difficult to acquire, but if u grow a tobacco plant in ur backyard right now, u think ur neighbor is gonna call the cops on you?)

I just want to get/keep a job without flunking a drug test cuz this s**t isn't legal yet.

Just so you know, if you have your recommendation from a doctor in a marijuana dispensary that is raided by the D.E.A. or L.A.P.D (or whoever) in California, Nothing happens to the patients. NOTHING

I myself have a recommendation for 5 years almost and have went to a few spots that are no longer around and were raided. No one has ever called me for anything related to it at all. No mail to go to court,no phone calls... nothing.
There are waaaaay too many people with these recommendations and nowhere nearly enough D.E.A. manpower to go around. And they could care less who smokes herb! They really want the bigtime growers up north mostly and the dispensaries so they can steal the money from them, it's all for the $$$$

The governement is simply taxing people for money, I mean if cigarettes and alcohol are legal, do you really think they are looking out for you? It's the $ that drives the D.E.A.'s fake "war on drugs". Just thought I'd clear up some things.

Oh and go watch "Super High Me"

and then in 30 years when you try to buy life insurance is it impossible because you were diagnosed with ibs or chronic pain? just curious, its something to think about since they won't insure smokers/chronically ill people. It's not just an immediate gratification thing, and all these bulls**t prescriptions aren't helping the common persons perception of marijuana decriminalization. Somtimes us folks in cali don't realize how backwards the rest of the nation is, and all i hear from my relatives and friends in other states are exaggerated stories about 18 year olds getting diagnosed with glaucoma. If you want to get the government on the side of legalization, perhaps committing fraud isn't the best way to convince them that we stoners are progressive.

decriminalization= self control

legalization= government control and the quickest way to guarentee 70 dollar 8ths for everyone.

How would any life insurance company ever know you had a medical marijuana recommendation? Unless you tell them of course...
And life insurance companies don't insure "cigarette/tobacco" smokers of course, haven't heard a thing about marijuana users.

And "bulls**t prescriptions" is hardly what it is, I have seen people with serious problems in the dispensaries as well as people with non-life threating issues. There are MANY reasons people use it medicinally. From anxiety to brain or breast cancer, it helps all kinds of issue people have.

And you are asking us not to commit fraud to the U.S. Government??? haha They have committed the biggest frauds in History And Legalizing a plant that should have NEVER been illegal is hardly a fraud, it's our right.

p.s. I get kush and bomb sativa's for $45 an 8th all day at the spot I go. I f people are paying $70, then they are getting ripped off plain and simple.

It's not under SB420 or Prop. 215.

I believe it works like this...

Since the State legalized it, a person may apply to be a dispensary owner (There needs to be suppliers for a medicine they had just approved. Medical marijauna dispensaries generate millions of dollars per year for the State). So, it's really up to the cities on how they want to regulate it. A city must have a memorandum to ban dispensaries. If they don't, then the application for a business license to run a dispensary must be approved. Some cities that have put up a memorandum to ban are not allowed to shut down existing dispensaries. They are fully licensed and permitted by the State to operate until their business license expires.

word, i always wondered, When all the raiding went down in SD with like 13 dispensaries in 1 day, half the clubs were baffled as to why, I see why/how a city could do that though. It also goes into the dispensaries responsability too though i guess, cuz im sure some of those places got s**t for helping non patients or opening up without jumping through the proper loops. That is kinda wild though that the TAX from each clinic varies depending on the city... or do they base that off of volume/traffic?

you can get brand new recommendations for $80 and renewals for $50. ya just gotta look around.

and ain't none of us goin' to jail for having a f**king weed license.

i love it (have had it for 4 years now), and i used to be heavily involved with street distribution so you'd think i would be inclined to that.

but i'm not.

i like the professional atmosphere, i like a GUARANTEED selection, i like being able to try out different kinds in the hash bar (it's like f**kin' amsterdam right down the street), yeah, it's a little pricey, but many places give you a discount for bulk (i know it's STILL pricey), but it does bring down the price a little.

what you need to do is negotiate with the dispensaries.

tell them you want a half oz price, but 2 quarters of different strains (this way you don't build up a tolerance to one particular strain).

i buy 2 ounces of chronic shake a month for $100 apiece, too (that's my latest new thing) in addition to my half a month.

there's noone on the streets selling ounces of chronic shake consistently for $100.

this is my system to get through the days.

i tell you i hate calling someone that's supposedly got weed, then they don't got it, they gotta call someone, then you're waiting, it's like f**k i didn't want pills or yayo, i wanted f**kin' weed you jackass.

anyway, i like going to the store to buy bombass, slightly over-priced, yet always guaranteed to be there and be bomb chronic. it keeps life simple.

i don't need shady people, unreliable connects, possible law enforcement interference, or to wait for it (i want my shizz immediately!!).

Believe it or not, I'm 28 and have the early signs of glaucoma (elevated pressure in the eye) according to my optometrist. So yes, you can be under 50 years old and get it.

"Glaucoma affects one in two hundred people aged fifty and younger, and one in ten over the age of eighty."

I'm def. ganna look into getting my card. I'd much rather smoke pot than be on any "pharmaceutical" perscriptions. But you know these side effects for glaucoma meds sound Really appealing!

Headaches and burning of the eyes
rapid heart rate or fluctuations in heart rhythm.
Tingling or loss of strength of the hands and feet.
upset stomach
depression
kidney stones
frequent urination
reduced libido

I firmly believe that if you need it, SMOKE it.

No, nothing is filed with the State and a patient must be notified prior to that. Yes, it is kept private form medical community as well. There is something in the works to protect medical marijuana patients from employer discrimination.

There is a Medical Marijuana Card program with the City of Los Angeles. Supposedly you get more respect from local law enforcement...but that's the list you DON'T want to be on. You have to pay for that and file with the city. Dispensaries DO NOT turn in any paperwork to the city in regards to their patients. They only turn in their income info.

the TAX is based on the income filed with the State.

Some dispensaries are sought after because like you said they didn't file things correctly OR they are not following city guidelines. In Los Angeles a patient can only come in once a day and cannot purchase more than half a pound in a day. Some places don't follow this to get more $ but they are flagging their own dispensary because then that's way too much traffic.

the raids in SD are now in the hands of Blackwater! that's freakin scary. DEA has hired them to raid these places and the training grounds are in SD...so that's why there are a grip of Federal raids there. Regardless of the city meetings with Federal Law, DEA & Blackwater still continue to RAID in retaliation for control of power.

oh yea...and i forgot to say that your medical marijuana script allows you to grow up to 12 total plants...so you wouldn't have to rely on anyone. if any plants are confiscated, they must return it unharmed within reason or the police department could get a lawsuit. i have a patient who grows in his backyard, in the ground and they are huge. he showed all his neighbors his dr's script and they are all good. there was a time tho where police confiscated it and the fireman on location told him that he thinks the patient has he right to have it and he best not damage it. an hour later the patient walked out the front doors of the police department with his 7 foot plant!

You guys think that your rights are protected and that your information is personal? Thats naive, there are people all over the state whos employers don\'t give a s**t. If you really think you can hire a lwayer and fight the good fight, then i\'m all for it. You really think that you are safe and protected from government and personal intrusion because of some doctor passing out prescriptions like candy on Halloween ....you are high.

A California man with a prescription for medical marijuana was fired for failing an employee drug test, so he sued his employer; now the California State Supreme Court says he has no case.

Gary Ross, a 45-year-old computer technician, was hired by the company RagingWire Communications in 2001. Ross was fired just 11 days after his hire for failing a mandatory employee drug test by testing positive for marijuana.

Ross and the company are located in California, where state laws declare that marijuana can be legal if prescribed by a doctor. Ross had such a prescription for back spasms caused by an old injury.

Ross decided to sue the company for his dismissal, citing both disability discrimination and the violation of California’s Proposition 215, which allows for the legal use of the drug.

The case went all the way to the California State Supreme Court, who this week decided in a 5-2 majority that Ross had no case, stating that the law was intended only to protect legal users from federal prosecution, not allow them protection from employer rules.

The high court upheld a small Sacramento telecommunications company\'s firing of a man who flunked a company-ordered drug test. Gary Ross held a medical marijuana card authorizing him to use the drug to treat a back injury suffered while serving in the Air Force.

The company, Ragingwire Inc., argued that it rightfully fired Ross because all marijuana use is illegal under federal law, which does not recognize the medical marijuana laws in California and 11 other states.

The U.S. Supreme Court declared in 2005 that state medicinal marijuana laws don\'t protect users from prosecution. The Drug Enforcement Administration and other federal agencies have been actively shutting down major medical marijuana dispensaries throughout California over the last two years and charging their operators with felony distribution charges.

Ragingwire said it fired Ross because it feared it could be the target of a federal raid, among other reasons.

The Santa Clara Valley Transportation Authority and the Western Electrical Contractors Association Inc. had joined Ragingwire\'s case, arguing that companies could lose federal contracts and grants if they allowed employees to smoke pot.

The conservative nonprofit Pacific Legal Foundation said in a friend-of-the-court filing that employers could also be liable for damage done by high workers.

Ross had argued that medical marijuana users should receive the same workplace protection from discipline that employees with valid painkiller prescriptions do. California voters legalized medicinal marijuana in 1996.

The nonprofit marijuana advocacy group Americans for Safe Access, which represents Ross, estimates that 300,000 Americans use medical marijuana. The Oakland-based group said it has received hundreds of employee discrimination complaints in California since it began tracking the issue in 2005.

The American Medical Association advocates keeping marijuana classified as a tightly controlled and dangerous drug that should not be legalized until more research is done.

You are talking about "drug tests" thats a whole different subject. A private business has the right to fire someone for many reasons....We never said anything about that. It is LEGAL in the STATE OF CALIFORNIA.

Government, State, and private business are all different situations.
